1. This agreement
These terms are the agreement between the provider of K-Stra identified at the end of this page (“K-Stra”, “we”) and the business that uses K-Stra (“you”, the “customer”). They apply to the K-Stra web application at www.k-stra.com/a/, its public API and MCP server, and to every purchase of credits.
K-Stra is sold to businesses and professionals only, not to consumers. By creating an account or buying credits on behalf of an organisation, you confirm that you are at least 18 years old and authorised to accept these terms for that organisation.
You accept these terms, and the privacy policy, with an explicit switch when you create your account. We record which version you accepted and when.
2. The service
K-Stra is a geomarketing application: it computes catchments on the road network and returns statistics on population, income, spending, businesses and property for Australian areas, and lets you analyse your own files against them. The coverage, the modules and the data sources are described on the website and may evolve.
Figures produced by K-Stra are estimates built from official statistics, commercial data and models. They support decisions; they are not a guarantee of results, and you remain responsible for the decisions you take with them.
3. Accounts and organisations
Anyone may explore the map, drive-time areas and area dashboards without an account. Running analyses, using the AI assistant, uploading files and buying credits require an account.
Each account belongs to an organisation. The organisation owns the credit balance, the analyses, the reports and the uploaded files, and its owner decides who joins and with which role. You are responsible for the activity of the people you invite and for keeping sign-in details secure; tell us immediately at info@k-stra.com if you suspect unauthorised access.
4. Credits, prices and payment
Analyses are paid with credits. Browsing maps, areas and dashboards, changing themes and filters, exporting and sharing results are free. Credits are spent only when you run an analysis or ask the AI assistant, at the tariff shown in the app before you confirm. A run that fails or is interrupted is not charged, and a retry is not charged again.
A free account starts with 40 welcome credits, valid for 12 months, once per organisation. Until the organisation buys credits, its balance is topped back up to 20 credits each month; top-up credits expire at the end of the month and do not add up.
Credits expire: credits from one-off packs after 12 months; credits from a monthly plan at the end of the month after the month in which they were added; welcome credits after 12 months; top-up credits at the end of the month. Credits that expire first are spent first, and we email the organisation one week before paid or welcome credits expire. Expired credits have no cash value.
Prices are shown on the pricing page and in the app, in the currency of your organisation, and exclude taxes. Applicable taxes are added at checkout according to your organisation’s country and tax registration. Payments are processed by Stripe; we never receive or store card details.
Dataset storage beyond the first 50 MB is charged at 2 credits per 100 MB per month, on the average space used in the month. If the charge cannot be paid, the organisation’s datasets are suspended and, after 90 days of suspension, deleted; we warn you by email one week before deletion.
5. Packs and monthly plans
Credits can be bought as one-off packs (150 and 600 credits) with no subscription required, or through a monthly plan (300, 1,000, 3,000 credits a month). An organisation can have one plan at a time. Moving to a larger plan applies immediately, with the difference charged pro rata; moving to a smaller plan applies from the next renewal. With an active plan you can still buy packs.
A plan renews automatically every month until cancelled. You can cancel at any time from the app: cancellation stops the next renewal, and the credits already received remain usable until they expire.
6. Refunds
Credits, packs and plan renewals are not refundable and cannot be exchanged for money, except where the law requires it. If a run was charged by mistake, we check the activity log and return the credits to the balance.
Nothing in these terms excludes rights that cannot be excluded by law, including the consumer guarantees of the Australian Consumer Law where they apply to you.
7. Your data and what you may upload
You keep all rights in the files you upload and in the analyses and reports you create. You give us only the permission needed to store, process and display them in order to provide the service to your organisation. We do not sell your data, do not combine it with other customers’ data and do not use it for any other purpose.
K-Stra is not designed to process personal information in uploaded files, and you must not upload any. Before uploading, you must remove or anonymise every element that identifies or could reasonably identify a person — such as names, email addresses, telephone numbers, customer or loyalty card numbers linked to a person, and the exact address of a private individual — for example by aggregating records by area or by using codes that cannot be traced back to a person by anyone outside your organisation. You must never upload sensitive information, such as data about health, ethnic origin, political opinions, religious beliefs, sexual orientation, trade union membership, biometric or genetic data, or criminal records.
You are solely responsible for the content you upload and for having the right to use it. If a file you upload nevertheless contains personal information, you remain responsible for that information under the laws that apply to it, the customer data terms apply, and we may suspend or delete the file.
A dataset marked “session only” is deleted 24 hours after upload. Backups taken before deletion keep a copy until they rotate, which takes about four months.
8. Acceptable use
You must not:
- use K-Stra in breach of any law, or to infringe anyone’s rights;
- upload malware or content you have no right to use;
- attempt to access data of other organisations, bypass limits or security measures, or probe the service for vulnerabilities without our written consent;
- extract the underlying data systematically to rebuild, resell or redistribute it as a dataset, or use K-Stra to build a competing product;
- create accounts to obtain welcome credits repeatedly, or overload the service with automated traffic beyond the documented API limits.
9. API, MCP and webhooks
The public API and the MCP server use API keys issued in the app. An API key spends your organisation’s credits at the same tariff as the app, within the limits you set for it; keep it secret and revoke it if it is exposed. Webhook endpoints you register receive data about your analyses at the address you choose, under your responsibility.
10. Intellectual property and data sources
K-Stra, its software, design and models, and the compiled datasets it provides belong to us or to our licensors. Official statistics come from the Australian Bureau of Statistics and other public sources under their licences; map tiles are © Mapbox and © OpenStreetMap contributors. You may use, export and publish the results of your analyses for your business, keeping the source notes that accompany every table and export.
11. Use of your name and logo
Unless you tell us otherwise, we may identify your organisation as a customer of K-Stra and show its name and logo on our website, in presentations and in other materials that present K-Stra, in a form consistent with your brand guidelines. This never implies that you endorse K-Stra: quotes, statements or case studies require your separate written consent.
You can opt out at any time by writing to info@k-stra.com. We stop any new use immediately and remove existing uses from our own materials within 30 days.
12. Availability and changes to the service
We work to keep K-Stra available and accurate, but we do not guarantee uninterrupted or error-free operation. Maintenance, updates of the data and events beyond our control may interrupt the service. We may improve, change or retire features; when a change materially reduces a paid feature you rely on, we tell you in advance.
13. Warranties and liability
Except as stated in these terms and to the extent permitted by law, the service is provided “as is”, without warranties of fitness for a particular purpose or of particular results.
To the extent permitted by law, our total liability arising from or in connection with K-Stra in any 12-month period is limited to the amounts your organisation paid us in the 12 months before the event that gave rise to the claim, and we are not liable for indirect or consequential loss, lost profits, lost revenue or lost business opportunities. These limits do not apply to liability that cannot be limited by law, including for fraud, wilful misconduct or gross negligence.
You are responsible for the content you upload and for its compliance with the law, and you indemnify us against claims by third parties arising from content you uploaded in breach of section 7.
14. Suspension, termination and deletion
You can close your account at any time from the app. We may suspend or close an account that breaches these terms, after notice where the breach can be remedied, or immediately for serious breaches such as attempts to access other customers’ data.
When an organisation is closed, its analyses, reports and uploaded files are deleted within 30 days; copies in backups are overwritten as backups rotate, in about four months. Records we must keep by law, such as invoices, are kept for the period the law requires. Unused credits lapse when the organisation is closed.
15. Changes to these terms
We may update these terms. We email the owners of each organisation at least 30 days before material changes take effect, and the new version is shown in the app for acceptance. Earlier versions remain available on request. If you do not accept a change, you can cancel your plan and close your account before it takes effect.
16. Governing law and disputes
These terms are governed by the laws of New South Wales, Australia. The parties submit to the non-exclusive jurisdiction of the courts of New South Wales, Australia, and the courts competent to hear appeals from them. Before starting proceedings, each party will try in good faith to resolve the dispute by writing to the other.
